28.10.2024 Heard Ms. S Das, learned counsel for the petitioner and Ms. S B Hazarika, learned Additional Public Prosecutor, Assam for the State. 2) By this application filed under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner, namely Diganta Baishya, S/o Hare Krishna Baishya, resident of village Doulasal, P.S.-Mukalmua, District-Nalbari, suspecting his arrest in Page No.# 2/2 said Mukalmua Police Station Case No. 168/2024 registered under Sections 325/307/75 of the Juvenile Justice (Care and Protection of Children) Act, has prayed for his pre-arrest bail. 3) The Court vide order dated 11.07.2024, called for the up-to-date case diary and granted interim bail to the petitioner in said Mukalmua Police Station Case No. 168/2024. 4) However, though the matter was listed on 30.07.2024, 12.09.2024 and

30.09.2024, but the concerned Investigating Officer failed to place the relevant case diary of said Mukalmua Police Station Case No. 168/2024 before the Court. 5) As the matter was listed today, during the deliberation of the matter, Ms. Das, learned counsel for the petitioner placed before the Court that the concerned I.O of said Mukalmua Police Station Case No. 168/2024 has already submitted charge sheet in the case on 13.07.2024 vide charge sheet No. 165/2024. 6) In view of the above, the petitioner is directed to approach the appropriate forum/authority for his regular bail, on or before 14.11.2024. 7) The interim order passed earlier on 11.07.2024, granting pre-arrest bail to the petitioner in said Mukalmua Police Station Case No. 168/2024 corresponding to GR No. 559/2024 is now extended only upto 14.11.2024, enabling the petitioner to appear before the appropriate forum for his regular bail as directed. 8) Accordingly, this anticipatory bail application stands closed.
