16.08.2024 Heard learned counsel, Mr M Hossain, for the petitioner, Faruk Ali @ Omar Faruk, who has filed this application under Section 482 of the BNSS, 2023, with prayer for pre-arrest bail as he is apprehending arrest in connection with Dhubri PS Case No. 112/2024, corresponding to GR Case No. 371/2024.

¶2Heard Mr B B Gogoi, learned Additional Public Prosecutor, for the State of Assam. Page No.# 2/2

¶3Learned Additional Public Prosecutor has raised serious objection stating that there are incriminating materials in the Case Diary against the petitioner. The victim Hekmat Ali has sustained grievous injuries on his head.

¶4I have also scrutinized the Case Diary, along with the Medico-Legal Report of the victim. Indeed, there are incriminating materials in the Case Diary against the petitioner.

¶5At this juncture, there appears to be no justified ground to extend the privilege of anticipatory bail to the petitioner. Petition stands rejected.

¶6Send back the Case Diary.
