ORDER

¶1Heard learned counsel Ms. P. Borah for the petitioners namely, (i) Nabajyoti Page No.# 2/2 Tamuli, and (ii) Suresh Tamuli.

¶2The petitioners have filed this application under Section 482 of the BNSS, 2023 with prayer for pre-arrest bail as they are apprehending arrest in connection with Morigaon Police Station Case No. 135/2024 under Section 306 of the IPC.

¶3Heard Mr. B. B. Gogoi, learned Additional Public Prosecutor, Assam for the respondent State.

¶4The allegation against the petitioners is that they have induced and instigated the victim to commit suicide.

¶5Learned Additional Public Prosecutor has submitted that there are incriminating materials in the Case Diary against the petitioners. The victim before taking his life had written a suicide-note which is also in the Case Diary.

¶6I have scrutinized the Case Diary. Indeed there are incriminating materials in the Case Diary against the petitioners.

¶7At this stage, there appears to be no justified ground to extend the privilege of anticipatory bail to the petitioners. Hence, petition is rejected.

¶8Send back the Case Diary. JUDGE Comparing Assistant
