Bijay Rabha v. The State of Assam

ORDER Date : 20.08.2024 Heard Mr. S. Barman, learned counsel for the petitioner. Also heard Mr. P. S. Lahakar, learned Additional Public Prosecutor for the State of Assam.

¶2This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 praying for granting pre-arrest bail in respect of Boko P.S. Case No.168/2024.

¶3The informant has alleged that on the day of occurrence, while he was driving a Motorcycle, he was stopped by the present petitioner. According to the informant, the Page No.# 2/2 petitioner tried to kill him by tying a waist belt around his neck and thereafter the petitioner had beaten him.

¶4The Case Diary revels the accused person had borrowed some amount of money from the informant and when the accused failed to return the money, the informant had informed the wife of the accused about that fact.

¶5Apart from that, there are no sufficient materials against the present petitioner to justify his detention in custody.

¶6The pre-arrest bail application is allowed.

¶7The interim bail granted to the petitioner Bijay Rabha is made absolute.

¶8The bail application stands disposed of.

¶9Case Diary shall be returned back.
