Shofikur Rahman @ Shofiqur Rahman v. The State of Assam and 4 Ors

ORDER Date : 16-09-2024 Today none appears for the petitioner on call. On the last occasion also i.e. on 01.05.2024, none had entered appearance on behalf of the petitioner. The petitioner herein has presented a challenge to the nomination of the respondent No.5 to the post of Muslim Marriage Registrar, Lakhipur, Goalpara. It is stated in the Bar that Assam Muslim Marriage and Divorce Registration Act, 1995 has since been repealed and accordingly, the present writ petition would not be maintainable. As none has appeared on behalf of the petitioner today, this Court restrains itself from proceeding to dismiss the matter on merit. However, there being no representation on behalf of the petitioner today as well as on the last date of listing, this Court proceeds to dismiss the writ petition for non-prosecution. Accordingly, the writ petition stands dismissed for non-prosecution.
