Heard Mr. M Hoque learned counsel for the petitioner and Mr. M.P. Goswami learned Addl. PP, Assa,. Page No.# 2/2 By this application under section 482 of the BNSS, 2023 the petitioner, namely, Sairuddin Ali @ Sairuddin Ahmed has prayed for granting pre arrest bail who is apprehending arrest in connection with Sipajhar PS Case No.49/2024 under sections 8 of the POCSO Act, 2012. It is submitted by the learned Addl. PP that charge sheet being CS No.94/2024 dated 01.07.2024 has already been filed by the Investigating Officer after completion of the investigation. In that view of the matter the present bail application stands disposed of by giving liberty to the petitioner to appear before the learned court below by filing appropriate application seeking regular bail and in the event filing such application, the learned court below shall consider the same in accordance with law. Accordingly, this bail application stands disposed of.
