Oriental Insurance Co. Ltd v. On the Death of Goma Dhar Her Legal Heirs 1.(1) Smti Neha Dhar and 2 Ors,

ORDER The case is put up before the National Lok Adalat. The Insurance Company is represented by its officials. On behalf of the claimant, his legal heir namely Smti. Neha Dhar, is duly present along with engaged counsel. It is submitted that the earlier awarded amount was Rs. 6,83,000/- (Rupees six lakhs eighty-three thousand) only and out of which, the Insurance Company has already deposited an amount of Rs. 3,41,500/- (Rupees three lakhs forty-one thousand five hundred) only. Both the parties are agreed to settle the matter on an amount of Rs. 7,50,000/- Page No.# 3/3 (Rupees seven lakhs fifty thousand) only as full and final settlement and since an amount of Rs. 3,41,500/- (Rupees three lakhs forty-one thousand five hundred) only has already been deposited by the Insurance Company, they are ready to pay the remaining amount of Rs. 4,08,500/- (Rupees four lakhs eight thousand five hundred) only towards the settlement amount. Accordingly, as agreed to by both the parties, the appellant/Oriental Insurance Company Ltd. is hereby directed to deposit the remaining amount of Rs. 4,08,500/- (Rupees four lakhs eight thousand five hundred) only before the Registry of this Court within a period of 1 (one) month from today and the claimant will be at liberty to withdraw the same along with the earlier deposited amount of Rs. 3,41,500/- (Rupees three lakhs forty-one thousand five hundred) only, if not already withdrawn, on being proper identification of the claimant's legal heir, i.e. Smti. Neha Dhar bank details, Aadhar Card, Pan Card etc. Registry to return the statutory deposited amount of Rs. 25,000/- (Rupees twenty five thousand) only to the Insurance Company, if any.

The appeal stands disposed of in terms above.
