Md. Mohiruddin Ali v. The State of Assam

ORDER Date : 19.08.2024 This is a common order for these two bail applications as both the bail applications have arisen out of the same police case.

¶2Heard Mr. K.I. Mazumder, the learned counsel appearing for the petitioner in BA No.2143/2024 and Mr. S. Alim, the learned counsel appearing for the petitioner in BA No. 2061/2024. Also heard Mr.D. Das, the learned Additional P.P. for the State of Assam.

¶3Both the bail applications are filed under Section 483 of BNSS, 2023 praying for grant of regular bail to the present petitioners, Surut Jamal @ Surut Jamai and Md. Mohiruddin Ali, who were arrested in connection with Jagiroad P. S. Case No. 126/2024.

¶4One truck bearing registration No. AS/01LC/0355 loaded with articles worth Rs. 2 lakhs at Delhi. The truck was sent to Assam for delivery of the goods. At the place of occurrence, the truck was stopped by another vehicle. The driver and handyman of the said truck bearing registration No. AS/01LC/0355 were thrown out of the truck and some people unloaded the Page No.# 3/3 entire goods and loaded in the new truck. Subsequently, police had to rescue the driver and handyman of the said truck.

¶5The case diary reveals that this type of incident was committed by some habitual offenders at the said place. They have been doing such things for a long time.

¶6This Court finds that there are no grounds for releasing the petitioners on bail.

¶7Both the bail applications stand dismissed and disposed of accordingly. The CD (s) shall be returned.
