Heard Mr. S. Islam, learned counsel appearing for the petitioner.
¶2This is an application under Article 227 of the Constitution of India challenging the order dated 28.02.2024 passed by the learned Member, MACT, Barpeta in MAC Case No.342/2023.
¶3The petitioner filed the claim application before the Tribunal after a delay of about two months. She had shown the cause for delay but the learned Tribunal refused to accept the plea taken by the petitioner.
¶4After going through the materials, this Court is of the opinion that the petitioner had satisfactorily shown the cause of delay. Thus, this Court is again of the opinion that the learned Tribunal has erroneously interpreted the cause shown by the petitioner.
¶5Resultantly, the impugned order is bad in law. The order dated order dated 28.02.2024 passed by the learned Member, MACT, Barpeta in MAC Case No.342/2023, is set aside.
¶6The Tribunal is directed to dispose of the MAC Case No.342/2023 in accordance with the procedure as laid down by law. With the above direction, the Revision Petition is disposed.
