Safikul Islam v. The State of Assam

ORDER 13-11-2024 Heard Mr. N Ahmed, learned counsel for the petitioner and Ms. S H Bora, learned Additional Public Prosecutor, Assam for the State.

¶2By this application under Section 482 of the BNSS, 2023, the petitioner, namely, Safikul Islam, son of Tula Miah, resident of village-Rubhi, P.S.-Kalgachia, District-Barpeta is seeking pre-arrest bail in Kalgachia Police Station Case No. 59/2024 registered under Sections 457/380 of IPC corresponding to G.R. No. 644/2024. Page No.# 2/2

¶3During the deliberation of the matter, Ms. S H Bora, learned APP, Assam, on instruction, has submitted that police after completion of the investigation of the case has already submitted Charge-Sheet in said Kalgachia P.S. Case No. 59/2024 vide Charge Sheet No. 68/2024 dated 17.07.2024.

¶4In view of the above, the petitioner is directed to appear before the appropriate forum/authority for his regular bail in said Kalgachia P.S. Case No. 59/2024 on or before

22.11.2024.

¶5Till then, i.e., 22.11.2024, the petitioner shall remain on interim bail granted to him earlier on 22.07.2024.

¶6Accordingly, this pre-arrest bail application stands disposed of.
