ORDER

22.08.2024 Heard Mr J Ahmed, learned counsel for the petitioner, Kamar Uddin Ahmed, who has filed this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, with prayer for bail as he is apprehending arrest in connection with Lumding PS Case No. 71/2024, under Sections 381/411 of the IPC.

¶3It is submitted by the learned counsel for the petitioner, Mr Ahmed that the accused/petitioner is innocent and he is in no way connected with the alleged offence as stated in the FIR. The actual fact of the case is that the petitioner was an employee of the RND Department at Ajmal Group's Hojai Unit, and accordingly, on 05.02.2024, he submitted his resignation letter for which, the company's head is pressurizing him to re-join the said post and on this basis only, the aforesaid FIR has been lodged against him. The petitioner accordingly prays for grant of pre-arrest bail and also submits that he is ready to co-operate with the investigation of this case, if so granted.

¶4I have scrutinized the Case Diary.

¶5I have considered the submissions at the Bar with circumspection.

¶6The petitioner has appeared before the IO and his statement has been recorded.

¶7The merits of this case are not brought to the fore.

¶8I have considered the fact that the petitioner has not violated any stringent bail conditions.

¶9The interim pre-arrest bail order dated 22.07.2024, is hereby made absolute, under the same terms and conditions.
