Nasim Uddin Choudhury @ Nasim Uddin v. The State of Assam

ORDER Date : 02-08-2024 Heard Mr. A Barbhuiya, learned counsel for the petitioner and Mr. M.P. Goswami learned Addl. PP, Assam. By this application under section 482 of the BNSS, 2023 the petitioner, namely, Nasim Uddin Choudhury @ Nasim Uddin has prayed for granting pre arrest bail who is apprehending arrest in Page No.# 2/2 connection with Ratabari PS Case No.131/2024 under sections 120(B)/420/406/409 IPC corresponding to GR Case No.1237/2024. It is submitted by the learned Addl. PP that charge sheet being CS No.102/2024 dated 29.07.2024 has already been filed by the Investigating Officer after completion of the investigation. The message sent to Mr. D Das learned Addl. PP as regards filing of the charge sheet is kept on record and marked with the document 'X'. In that view of the matter the present bail application stands disposed of by giving liberty to the petitioner to appear before the learned court below by filing appropriate application seeking regular bail and in the event of filing such application, the learned court below shall consider the same in accordance with law. Accordingly, this bail application stands disposed of.
