Heard Mr. S. Borthakur, learned counsel for the petitioner. Also heard Mr. S. Das, learned standing counsel for the respondents No. 1 and 2 and Mr. V. Rajkhowa, learned counsel for the respondents No.3 and 4. During the course of the hearing, Mr. S. Borthakur, learned counsel for the petitioner has placed a copy of the speaking order dated 12.10.2023 passed by the Director of Higher Education, Govt. of Assam, whereby the formal approval of the petitioner as Assistant Professor in the Department of Assamese, of Goalpara College has been accorded w.e.f. 04.09.2002 with all consequential benefits as per the Hon'ble High Court's order dated 19.11.2003 passed in WP(C) 3708/2007. It is noticed that the prayer made in the writ petition is for a direction to accord formal approval of appointment of the petitioner and to pay arrear as well as current salary as regular Asstt. Professor of the college according to state pay scale. The order clearly indicates that the formal approval has been accorded in favour of the petitioner with all consequential benefits in terms of the order of the Court dated 19.11.2003 passed in WP(C) 3708/2007. Thus, I am of the view that the prayer of the writ petitioner has been duly considered by the respondent authorities. Accordingly, the writ petition stands closed and disposed of. A copy of the speaking order dated 12.10.2023 is kept on record and marked as 'X'.
