Heard the learned counsel Mr. T.A. Laskar appearing for the petitioners. I have also heard Mr. K.K. Parasar, the learned Addl. Public Prosecutor, Assam.

¶2This is an application under Section 482 of the BNSS, 2023 praying for pre-arrest bail in respect of Lanka P.S. Case No.160/2024, registered under Sections 461/380/413 of the Indian Penal Code.

¶3An amount of ₹1,77,800/- was stolen from a TATA Product Indicash ATM.

¶4The petitioners are apprehending that they might also be arrested by police. The petitioner Sajidur Rahman has claimed that he belongs to the district of Sivasagar. He has no connection with this case.

¶5The case diary reveals that the brother of Sajidur Rahman was arrested by police and he has stated before police that Sajidur Rahman and Mazidur Rahman are also involved in the aforesaid theft of money from ATM.

¶6Considering the aforesaid facts, the bail application of the present petitions is found to be not satisfactory. Therefore, the bail application stands dismissed. Case diary shall be returned.
