Judgment
ORDER 05-08-2024 Heard Shri Debashish Roy, petitioner-in-person, who by means of this petition has alleged willful and deliberate disobedience of the judgment and order dated 18.03.2024 passed by this Court in WP(C) No. 2102/2015. By the said judgment and order, 60 days time was granted to pass a speaking order. It is contended that though the speaking order has been passed on 14.06.2024, it Page No.# 2/2 has not followed the directions given by this Court. This Court is however of the opinion that in a matter alleging contempt, the essential aspect would be to see whether such disobedience/non-compliance is willful and deliberate. The speaking order passed on 14.06.2024 can be challenged in any other manner but whether a contempt would lie is a highly debatable issue. Shri Roy, the petitioner-in-person at this stage likes to withdraw this petition however with a liberty to challenge the said order in an appropriate manner. The contempt petition is accordingly closed with liberty as prayed for.
