Mr. R. K. Agarwal, learned counsel for the petitioner is present. He submits that in view of Section 35(k) of the IBC 2016 as well as in light of order dated

18.12.2023 passed by the NCLT, Guwahati bench in I.A. (I.B.C.)/3/GB/2023 in C.P.(I.B.)/18/GB/2021, he is under legal bar to appear for the petitioner in this case. The said submission is recorded.

¶2Mr. B. Chakravarty, learned CGC appearing for the respondent no.1 has submitted that he is in receipt of instruction dated 12.01.2021 by the Under Secretary to the Govt. of India, Ministry of Health & Family Welfare, Department of Health & Family Welfare (Food Regulation Section), that the order impugned in this writ petition has been withdrawn in view of the orders passed by the High Court of Delhi in WP(C) 8834/2020 and other connected matters.

¶3The learned CGC has provided photocopies thereof to be retained in record.

¶4In view of the submissions is made by the learned CGC, the matter has become infructuous. Page No.# 3/3

¶5Accordingly, this matter stands closed having been rendered infructuous.
