¶1Heard learned counsel Mr. A. Baruah for the petitioner Abjur Ali.

¶2This application has been filed by the petitioner under Section 482 of the BNSS, 2023 with prayer for pre-arrest bail as he is apprehending arrest in Page No.# 2/2 connection with PRC Case No. 76/2024 corresponding to Khetri Police Station Case No. 77/2017 under Sections 120(B)/341/294/326/307/323/34 of the IPC.

¶3Heard Mr. B. B. Gogoi, learned Additional Public Prosecutor, Assam for the respondent State and learned counsel Mr. S. Islam for the informant.

¶4It is submitted on behalf of the petitioner that Charge-sheet has been laid against the petitioner vide CS No. 63/2023 on 22.05.2023. The petitioner has been shown as absconder, but the petitioner is willing to co-operate with the trial and appear before the Trial Court. The petitioner is apprehending that he would be forwarded to custody and has prayed for anticipatory bail as bailable warrant has been issued against him vide order dated 11.06.2024 in connection with the aforementioned case.

¶5I have considered the submissions at the Bar with circumspection. The petitioner is willing to co-operate with the trial.

¶6I have taken a pragmatic view.

¶7The petitioner is therefore directed to appear before the Jurisdictional Court within 15 days and apply for bail, which may be considered by the Court in accordance with law.

¶8Till then no coercive action shall be taken.

¶9In terms of the above observations, petition is disposed of.
