ORDER

08.08.2024 Heard Mr B Ali Sk., learned counsel for the petitioner, Pranjal Medhi, who has filed this application with prayer for bail as he is behind bars since 11.06.2024, in connection with GRPS PS Case No. 133/2024, under Sections 120B/420/406/379 of the Indian Page No.# 2/3 Penal Code, 1860.

¶2The FIR unfolds that on 06.06.2024, three passengers, namely, Rajesh Mohammad, Raman Rai and Jehirul Bhuyan, informed the Police that a person took Rs. 2,500/- through online and cash of Rs. 500/-, for providing railway tickets, but after taking the amount, the miscreant fled the scene. The passengers informed the Police that they could identify the miscreant. Through CCTV footage, it was uncovered that the present petitioner was the aforementioned miscreant.

¶3It is submitted on behalf of the petitioner that he is behind bars for 58 days.

¶4The Case Diary is not received.

¶5Investigation may have progressed to a considerable extent.

¶6It appears that further custodial detention of the petitioner may not be required.

¶7After considering the submissions at the Bar and considering the length of detention, petition is allowed. The petitioner is enlarged on bail of Rs. 30,000/-with a suitable surety of the like amount to the satisfaction of the learned CJM, Kamrup (Metro), under the conditions that-

i) the petitioner shall refrain from such activities with which he is alleged,

ii) the petitioner shall cooperate with the remaining part of the investigation, and

iii) the petitioner shall not leave the jurisdiction of the Court, without prior Page No.# 3/3 permission.

7.1. On breach of any of the bail conditions, this bail order shall automatically stand cancelled.
