ORDER

03.09.2024 Heard Mr Y Kothari, learned counsel for the applicant, Amit Pegu @ Amit K Pegu. Also heard Mr B B Gogoi, learned Additional Public Prosecutor for the State of Assam.

¶2By this interlocutory application, the applicant, Amit Pegu @ Amit K Pegu, has prayed for release of the passport of the petitioner which was deposited before the learned Court of Sessions Judge, Kamrup(M) in compliance with the order dated

09.09.2021, passed in connection with Bail Application No. 2006/2021. Page No.# 2/2

¶3Mr Y Kothari, learned counsel for the applicant, submits that in compliance with the condition No.(b) in order dated 09.09.2021 passed in BA No. 2006/2021, the petitioner had deposited his passport before the learned Court of Sessions Judge, Kamrup (M), Guwahati. Mr Y Kothari further submits that the Investigating Officer concluded the investigation and laid charge-sheet on 25.10.2021 and the petitioner is regularly appearing before the learned trial court to face the trial. Mr Kothari further submits that he frequently travels outside India for business purpose and as such prays for release of his passport deposited before the learned court of Sessions Judge, Kamrup(M), Guwahati.

¶4After hearing the learned counsel for the applicant and considering the grounds cited in the petition, the prayer of the applicant is hereby allowed.

¶5Accordingly, the condition No. (b) of the order dated 09.09.2021 in Bail Appln. No. 2006/2021 is hereby modified and the learned court of Sessions Judge, Kamrup(M), Guwahati is directed to release the passport of the petitioner by retaining a legible scanned copy thereof.
