13.12.2024oooooooooooooooooo (VijaykBishnoi,kCJ) o The 2 matter 2 comes 2 upon 2 for 2 consideration 2 of 2 the 2 instant 2 Interlocutory Page No.# 2/2 Application, preferred on behalf of the applicant, under Section 5 of the Limitation Act, 1963, with a prayer to condone the delay of 219 days occasioned in filing the connected writ appeal. It is stated in the application that the applicant, being an old aged person, fell seriously ill in the month of February, 2024 and thereafter recovered only in March, 2024. It is also stated in the application that on account of his illness, the applicant was also facing some financial difficulties and as such, the delay has been caused in filing the connected writ appeal. Learned counsel appearing for the respondents has opposed the application and argued that the delay, caused in filing the connected writ appeal, has not been satisfactorily explained. Having heard the learned counsel for the parties and after going through the contents of the application, in the interest of justice, we deem it appropriate to condone the delay in filing the connected writ appeal. Hence, the instant Interlocutory Application is allowed and the delay of 219 days occasioned in filing the connected writ appeal is condoned. Registry is directed to register the connected writ appeal and list the same for admission in the last week of January, 2025. The instant Interlocutory Application is, accordingly, disposed of.
