Jyoti Das @ Jyotilal Das v. The State of Assam

ORDER Date : 21.08.2024 Heard Ms. A. Hussain, learned counsel for the petitioner. Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State of Assam.

¶2One application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, praying for pre-arrest bail in respect of Kachua P.S. Case No.50/2024 under Sections 341/326/307/34 of the Indian Penal Code.

¶3On the Day of occurrence, five specific persons other than the present petitioner Page No.# 2/2 allegedly attacked the informant and her family with sharp weapons. Police Registered the Case under Sections 326 and 307 of the Indian Penal Code.

¶4The Case Diary reveals that the injured persons sustained simple injuries only.

¶5Moreover, there are no sufficient materials against the present petitioner.

¶6Therefore the pre-arrest bail application of the petitioner is allowed.

¶7It is hereby directed that in the event of arrest in connection with Kachua P.S. Case No.50/2024 the petitioner Jyoti Das @ Jyotilal Das, shall be released on bail of Rs.20,000/- with a surety of like amount to the satisfaction of the arresting Authority.

¶8The bail application stands disposed of.

¶9Case Diary shall be returned.
