ORDER

15-07-2024 Heard Shri S. K. Goswami, learned counsel for the petitioner. Also heard Shri B. Choudhury, learned Standing Counsel, APDCL. The grievance of the petitioner was with regard to promotion to the higher post of DGM, APDCL. The petitioner, who was holding the post of AGM (Esstt./HQ) claims that two posts in the higher cadre were lying vacant and he was eligible in spite of which he was not promoted. It however appears that during the pendency of this case, there was a meeting of the Joint Consultative Committee (JCC) in which the case of the petitioner for promotion was however rejected. Shri Choudhury, the learned Standing Counsel has in fact placed a copy of the said minutes of meeting held on 28.09.2021 before this Court. Shri Goswami, the learned counsel for the petitioner has submitted that though the petitioner has retired in the meantime, the aspect of getting notional benefits would still be available if he successful in challenging the decision taken in the meeting dated 28.09.2021. In view of the above, the instant writ petition is closed however with a liberty to challenge the decision taken on 28.09.2021, if so advised. Shri Choudhury, the learned Standing Counsel has also informed this Court Page No.# 3/3 that the aforesaid meeting was held pursuant to an order dated 17.09.2021 passed in this writ petition and the same is also reflected in the minutes itself. Copy of the minutes dated 28.09.2021 is made part of the records.
