Biswajit Haloi v. The State of Assam

ORDER 04-11-2024 Heard Mr. J Kalita, learned counsel for the petitioner and Mr. B Sharma, learned Additional Public Prosecutor, Assam for the State.

¶2By this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending his arrest, the petitioner, namely, Biswajit Haloi, son of Bhaba Haloi, resident of Page No.# 2/2 village-Dirua, Police Station-Mukalmua of District-Nalbari, is seeking his pre-arrest bail in Panbazar Police Station Case No. 158/2024 registered under Sections 420/379 of the IPC, corresponding to G.R. No. 3913/2024.

¶3The Court by order dated 05.08.2024 while calling for the case diary granted interim bail to the petitioner in said Panbazar P.S. Case No. 158/2024, which is in force till date, i.e. 04.11.2024.

¶4During the deliberation of the matter, Mr. B Sharma, learned APP, Assam has submitted that police after completion of the investigation of the case have filed Charge-Sheet in said Panbazar P.S. Case No. 158/2024 on 29.09.2024 vide Charge-Sheet No. 155/2024.

¶5As such, the petitioner, named above, is directed to approach the appropriate forum on or before 12.11.2024 for his regular bail.

¶6For the said purpose, interim bail granted to the petitioner earlier on 05.08.2024 in Panbazar P.S. Case No. 158/2024 is extended up to 12.11.2024 only.

¶7With the above observation and direction, this pre-arrest bail application stands disposed of.
