Judgment
ORDER Date : 26-07-2023 Heard Mr. S.M. Abdullah P., learned counsel for the petitioner. Also heard Ms. S.H. Borah, learned Addl. P.P., Assam appearing for the State respondent who submits that though the C.D. was called for, the same has not arrived. It appears from the record that today is the second day of this case fixed for production of the C.D. However, no cause has been shown for not producing the C.D. The learned counsel for the petitioner submits that the petitioner has been detained Page No.# 2/3 behind the bars since last 46 days i.e. since 10.06.2023. On perusal of the FIR which is annexed as annexure-1 along with the bail application, it appears that one Smt. Himani Singha lodged an FIR on 03.06.2023 before the Officer In-charge of Bongaigaon P.S., inter-alia, alleging that her daughter Mousumi Singha committed suicide in the early morning of 07.05.2023 in her own room and it is also stated that the first informant suspects that when the present petitioner was harassing the daughter of the first informant mentally by falsely luring her to love him and blackmailing her , the daughter of the first informant committed suicide. I have considered the submissions made by the learned counsel for the petitioner as well as the learned Addl. P.P. who has objected to the bail prayer and also perused the materials available before this Court which is annexed with the bail application, though the C.D. has not been arrived. However, considering the contents of the FIR it appears that the present petitioner has been implicated in this case only on the basis of the suspicion of the mother of the deceased that he may be involved in compelling her daughter to commit suicide. Apart from this there is nothing on record. However, considering the length of period of detention already undergone by the present petitioner i.e. 46 days from the date of arrest in connection with Bongaigaon P.S. Case No. 227/2023, further custodial detention of the petitioner does not appear to be necessary. Hence, the present petitioner, namely, Ramen Singha is allowed to go on bail of Rs. 30,000/-(Rupees thirty thousand) with one surety of the like amount to the satisfaction of the learned CJM, Bongaigaon with the following conditions :-
¶1That the petitioner shall cooperate with the investigating officer of the Bongaigaon P.S. case No. 227/2023.
¶2That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade him or her from disclosing such facts to the Investigating Officer of this case.
