Krishna Borah v. The State of Assam

¶2This is an application under Section 483 of BNSS, 2023 praying for grant of bail to the petitioner, who was arrested in connection with Chandmari P. S. Case No. 178/2024.

¶3It is alleged in the FIR that on the day of occurrence, the son of the informant, Biki Tarafdar was beaten up by the petitioner, as a result of which, the victim was seriously injured. Later on, the present petitioner had taken the victim, Biki Tarafdar to the hospital, whose condition was critical.

¶4The case diary reveals that Biki Tarafdar was beaten by another person, Diganta Das and not by the present petitioner.

¶5Under the given circumstances of the case, the petitioner, Krishna Borah does not deserve to be detained in custody for further period of time.

¶6Accordingly, the petitioner, namely, Krishna Borah shall be allowed to go on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (Metro), Guwahati.

¶7The bail application stands disposed of accordingly. The CD shall be returned. JUDGE Comparing Assistant
