Judgment

O R D E R

13.12.2024

Heard Mr. B. Paul, the learned counsel for the petitioner.

¶2The instant contempt application has been filed alleging willful and deliberate violation to the order dated 10.02.2020 passed in WP(C) No.7523/2016 whereby there was a direction passed by this Court to consider the case of the petitioner for appointment under the die in harness scheme by placing the matter before the concerned DLC, Dhubri and the DLC, Dhubri thereafter to take consequential action thereof. It is seen from the records that the said order was placed before the respondents vide the communication dated 03.03.2020. Thereupon, on account of the outbreak of the COVID-19, the case of the petitioner could not be immediately taken up.

¶3Be that as it may, the DLC, meeting was held on 05.12.2020 and the DLC could not recommend the application of the petitioner for appointment on compassionate ground since the Committee was of the opinion that the application was filed beyond the prescribed period of one year from the death of the employee, and apart from that, the applicant was found under-Page No.# 3/3 aged at the time of filing the prayer petition.

¶4Taking into account the above, it cannot be said that the order passed by this Court on 10.02.2020 in WP(C) No.7523/2016 have not been complied with. Accordingly, the contempt proceedings stands dropped.

¶5Be that as it may, if the petitioner is aggrieved by the decision so taken in the DLC meeting held on 05.02.2020, the petitioner is always at liberty to assail the same, if otherwise permissible under law.
