Judgment
O R D E R
09.08.2024
Heard Mr. B. Deka, learned counsel for the petitioner, namely, Suren Tangla, who has filed this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for pre-arrest bail, as he is apprehending arrest in connection with Gingia Police Station Case No.58/2024 under Sections 74/329 of the Bharatiya Nyaya Sanhita, (B.N.S), 2023.
¶2Heard Mr. D. Das, learned Additional Public Prosecutor, Assam for the respondent State.
¶3The allegation against the petitioner is that in the pretext of checking the room inside the informant's house, the petitioner outraged the modesty of the informant.
¶4I have considered the submissions at the bar with circumspection. I have considered the submission that the petitioner has pledged to cooperate with the remaining part of the investigation.
¶5I have scrutinized the case diary. It appears that investigation has progressed to a considerable extent. It also appears that custodial interrogation may not be required to proceed with the investigation. The petitioner is a local resident and he is not a flight risk and he has pledged to cooperate with the remaining part of the investigation. The petitioner is willing to abide by any stringent bail conditions, if imposed upon him.
¶6Considering all aspects and in view of my foregoing discussions, petition is Page No.# 3/3 allowed.
¶7In the event of his arrest, the petitioner, namely, Suren Tangla shall be enlarged on bail on furnishing a bail bond of Rs.30,000/- (Rupees Thirty Thousand) with a suitable surety of like amount to the satisfaction of the arresting authority under the conditions that:
(i) The petitioner shall appear before the Investigating Officer within 1 (One) week and cooperate with the investigation;
(ii) The petitioner shall not go anywhere near the vicinity of the victim; and
(iii) The petitioner shall not leave the jurisdiction of the Court without prior permission.
¶8On breach of any of the bail conditions, anticipatory bail order shall stand automatically cancelled.
¶9Accordingly, this anticipatory bail stands disposed of. Send back the case diary.
