No.11/2021. By order dated

28.07.2021, the learned Sessions Judge, Dhubri admitted the said revision petition and stayed the operation of the order dated 17.05.2021 passed in Misc. Case No.81/2017 that was passed by the learned District Magistrate, South Salmara-Mankachar, Hatsingimari, until further order and called for the records of the case in original by issuing notice to the opposite parties for full and final hearing fixing the said revision petition on 20.08.2021 for hearing. 8) It is placed that the Court by order dated 06.09.2021, passed in said WP(C) No. 4363/2021, categorically directed the Superintendent of Police, South Salmara Mankachar and the Assistant Settlement Officer, Mankachar to comply with the order dated 17.05.2021, passed by the learned District Magistrate, South Salmara Mankachar, Hatsingimari in Misc. Case No.81/2017, if in the meanwhile, the same was not complied with and if there is no other legal impediment created in the meanwhile in compliance of the same, but in view of such direction, the learned Sessions Judge is not in a position to proceed with the said Cri.Revn.Pet. No.11/2021, presently pending before it with regard to said Misc. Case No.81/2017 wherein the learned District Magistrate passed the impugned order dated 17.05.2021. 9) It is stated at the Bar that said Crl. Revn. P. No.11/2021 has now been re-Page No.# 6/6 registered as Crl. Revn. P. No.5/2022 before the learned Sessions Judge, South Salmara, Mankachar. 10) Hence, this review petition by the petitioners/respondent Nos. 8 to 13 in said WP(C) No. 4363/2021. 11) After hearing the learned counsels for the parties and considering the entire aspect of the matter, it is clarified that since the learned Sessions Judge, Dhubri by order dated 28.07.2021 have already admitted the Crl. Revn. P. No.5/2022 relating to said Misc. Case No.81/2017 wherein the learned District Magistrate, South Salmara Mankachar, Hatsingimari passed the impugned order on 17.05.2021, it may proceed with said Crl. Revn. P. No.5/2022 and to come to a final conclusion by issuing necessary order considering the fact that the Court in the order dated 06.09.2021, passed in WP(C) No. 4363/2021 categorically observed that "if there is no other legal impediment created in the meanwhile regarding compliance of the said order dated 17.05.2021, passed in Misc. Case No.81/2017 by the learned District Magistrate, South Salmara Mankachar, Hatsingimari". 12) With the above observation and direction, this review petition stands disposed of.
