Nur Mahammad Ali and Anr v. The State of Assam

ORDER Date : 05.08.2024 Heard Mr. S.Islam, the learned counsel appearing for the petitioners as Page No.# 2/2 well as Mr. K.K. Parasar, the learned Additional P.P. for the State of Assam. This is an application under Section 482 of the BNSS, 2023 praying for grant of pre-arrest bail. Both the petitioners are charge-sheeted in a case under Sections 120(B)/294/341/326/307 of the Indian Penal Code read with Section 34 of the said Code. The petitioners apprehend that whenever they will appear before the court of learned Chief Judicial Magistrate, Dhubri, the learned Magistrate will ultimately commit the case to the court of sessions, and the Court of Sessions will remand them to custody. Therefore, both the petitioners have approached this Court for seeking relief. After considering the submissions made by the learned counsels of both sides, it is hereby directed that whenever the petitioners, namely, 1. Nur Mahammad @ Nur Mahammad Ali and 2. Nur Alom appear before the court of learned Chief Judicial Magistrate, Dhubri, in connection with PRC Case No. 729/2024, they shall be released on bail of Rs. 25,000/- each with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Dhubri,. The bail application stands disposed of.
