THE GAUHATI HIGH COURT (HIGH COURT OF ASSAM, NAGALAND, MIZORAM AND ARUNACHAL PRADESH) Case No. : AB/2015/2024 SMT. JULI DAS W/O MITHUN DAS R/O 1 NO. GALIYAHATI, N.B. ROAD, BARPETA, P.S. AND DIST. BARPETA, ASSAM, PIN-781301 VERSUS STATE OF ASSAM REP BY THE PP, ASSAM Advocate for the Petitioner : MR J DAS, T CHAKMA,MR. S R RABHA,P HAZARIKA Advocate for the Respondent : PP, ASSAM,
BEFORE HON'BLE MR. JUSTICE MANASH RANJAN PATHAK
04/10/2024 Heard Mr. S R Rabha, learned counsel for the petitioner and Mr. M P Goswami, learned Additional Public Prosecutor, Assam. The petitioner, namely, Smt. Juli Das, wife of Mithun Das, serving as Judicial Assistant in the office of the District and Sessions Judge, Barpeta, has filed this application under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail apprehending her arrest in Barpeta P.S. Case No. 274/2024 registered under Sections 61/318/316 of Bharatiya Nyaya Sanhita, 2023 corresponding to G.R. No. 881/2024. Page No.# 2/2 As per the FIR of the case lodged on 20.05.2024, the petitioner along with others are involved in fraudulent activities in the name of a company called Big Bigul and Unity Meta by collecting money and investing it in said Big Bigul and Unity Meta company assuring them to provide high rate of interest on their such deposits. The FIR of the case reflects that since the FIR named accused persons are officials, working in Government offices, people easily believe on their assurance and thereby they fall prey in such trap in investing money with such a fraudulent company. Perused the case diary placed before the Court today by Mr. Goswami, learned Additional Public Prosecutor, Assam. Case diary reveals sufficient incriminating materials with regard to the petitioner in her involvement in collecting such money from different persons for investment with the alleged fraudulent company assuring the investors to return their investment with huge interest. Case diary also reveals that the said company has already closed down and the investors with the said company are yet to receive their invested money and interest thereon. Considering such incriminating materials in the case diary against the petitioner with regard to her involvement in the alleged crime, the Court is of the view that it is not a fit case to grant pre-arrest bail to the petitioner, namely, Smt. Juli Das in said Barpeta P.S. Case No. 274/2024. Accordingly, this pre-arrest bail application of the petitioner, named above, in said Barpeta P.S. Case No. 274/2024 stands rejected. Return the case diary.
