Utsav Kumar v. The State of Assam

ORDER Date : 21-03-2024 Heard Mr. D. Nandi, learned counsel for the petitioner. Also heard Mr. M. Phukan, learned Public Prosecutor for the State/respondent. Page No.# 2/2 This is an application made under Section 438 Cr.P.C., praying for pre-arrest bail by the petitioner, namely, Shri Utsav Kumar, in connection with Vigilance P.S. Case No. 04/2023, registered under Sections 120B/420/406/409, IPC read with Sections 13(1)(a)/13(2), P.C. Act, 1988. Mr. Phukan, learned Public Prosecutor submits that in this case, charge-sheet has already been submitted vide C.S. No. 1/2024 dated 10.01.2024. It is also submitted that interim protection has already been granted to the petitioner by this Court vide order dated 23.08.2023. In view of the above, the present petition is disposed of with a direction to the petitioner to appear before the learned court below within 10 days from today and if any bail application is filed, the same will be considered by the learned trial court in accordance with law. Till such appearance, the interim protection granted to the petitioner shall remain in force.
