United India Insurance Co Ltd v. Sri Arup Jyoti Konwar and 5 Ors

ORDER Date : 15-03-2024 Heard Mr. K.K. Bhatta, learned counsel for the applicant. I have also heard Mr. M. Talukdar, learned counsel for the respondent No.1; Mr. A. Saikia, learned counsel for the respondent No. 4 and Ms. M. Chetia, learned counsel for respondent No. 4. The learned counsel for the parties submits that the matter amicably been settled between the parties outside the Court at Rs.6,50,000/-(Rupees six lakhs fifty thousand) only as a full and final amount to be paid by the appellant to the claimant. Hence, prays for closing the matter in terms of the settlement of the parties. The appellant shall deposit the settled amounts before the learned Member, MACT, Morigaon within 4(four) weeks from today and on such deposit, the Page No.# 3/3 claimant is at liberty to withdraw the entire amount. Since, the matter has already been settled, this I.A. has become infructuous and accordingly disposed of. Registry is directed to refund the statutory deposit to the appellant.
