Manowar Akand @ Manuwara Akhond and Anr v. The State of Assam

ORDER Date : 03.10.2024 Since both the bail applications arise out of the same FIR, both the bail applications are taken up for disposal by this common order.

¶2Heard Mr. S. Munir, learned counsel appearing for the petitioners. Also heard Mr. B. Sarma, learned Additional Public Prosecutor for the state of Assam.

¶3These two applications are filed under Sections 483 of the BNSS, 2023 seeking regular bail in respect of Sipajhar P.S. Case No. 102/2024.

¶4The allegation brought against the petitioners is that they had stolen the consignment carried by truck bearing registration No. AS01/HC/4341 after stopping the said truck on the road. Today, all the petitioners have completed 88 days of detention in custody.

¶5I have considered the submissions made by the learned counsels of both sides.

¶6This Court is of the opinion that at this stage, the petitioners no longer deserve to be detained in custody. Therefore, their bail applications are allowed.

¶7It is hereby directed that the petitioners, Monowar Akand @ Manuwara Akhond, Surpan Ali and Abbas Khan, who were arrested in connection with Sipajhar P.S. Case No. 102/2024 shall be released on bail of Rs. 25,000/- each with a surety of like Page No.# 3/3 amount to the satisfaction of the learned Chief Judicial Magistrate, Darrang, Mangaldai.

¶8With the aforesaid direction, both the bail applications are disposed of.

¶9The CD (s) shall be returned.
