Anar Hussain @ Md. Anar Hussain v. The State of Assam

ORDER Date : 21.08.2024 This is a common order for these two items. Heard Mr. S. Hoque as well as Mr. S. Bora, learned counsel for the petitioners.

¶2Both this applications are filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 praying for bail in respect of the petitioners, who are arrested in connection with Patacharkuchi P.S. Case No.132/2024.

¶3On the day of occurrence, at mid night a group of seven unknown persons, whose faces were covered by black cloth, armed with sharp weapons and other arms broke into the house of the informant. They were big by units and thereafter looted valuable gold ornaments and other items along with cash amount of Rs.3,00,000/-. The miscreants also damaged the CCTV camera monitor also.

¶4The Case reveals that the present petitioners were arrested on the basis of mobile call details. Other persons are yet to be arrested.

¶5This Court is of the opinion that at this stage, the bail application filed by Anar Hussain @ Md Anar Hussain and Dignata Das are not found to be satisfactory, for that reason both the bail applications are rejected and disposed of accordingly.

¶6Case Diary shall be returned.
