Heard Mr. B. Ali Sk., learned counsel for the petitioner as well as Mr. D. P. Goswami, learned Additional Public Prosecutor appearing for the State respondent No.1. This is an application under Section 528/438/442 of BNSS, 2023 praying for quashing the order dated 13.10.2023 and all the subsequent orders whereby Page No.# 2/2 the learned CJM, Dibrugarh issued and re-issued NBWA against the petitioner in connection with PRC Case No. 745/2018. It is submitted by the learned counsel for the petitioner that the petitioner has lost the contact number of his engaged counsel as a result of which, he was unaware about the dates fixed by the trial court and subsequently, warrant of arrest was issued. On the other hand, Mr. D. P. Goswami, leaner Additional Public Prosecutor opposed the prayer of the petitioner and submits that the case is pending in the court since 2018. Due to non appearance of the petitioner, the proceeding of the case is delayed. I have heard the learned counsel for both the parties. The grounds shown by the petitioner regarding his non-appearance before the trial court for such a long period is not satisfactory. In view of the above, the petitioner is directed to appear before the learned trial court and in the event of filing any bail application, the trial court shall consider the matter in accordance with law. In view of the above, this criminal petition stands disposed of.
