ORDER

20.09.2024. Heard Shri A Choudhury, learned counsel for the petitioner. Also heard Shri Borthakur, learned counsel appearing for the respondents. By way of this petition filed under Article 226 of the Constitution of India, the petitioner is challenging the order dated 23.08.2023 whereby the services of the petitioner was placed under suspension pending drawal of departmental proceeding on being arrested on 23.08.2023 by the Directorate of Vigilance & Anti-Corruption, Assam. It is submitted at the Bar that during the pendency of the writ petition, the petitioner has retired from service. It is further submitted at the Bar that in view of the superannuation of the petitioner, the case of the petitioner can be considered in the light of FR 54-B. In view of the aforesaid endorsement made by the learned counsel for the parties, this Court deems it appropriate to dispose of this writ petition with a liberty to the petitioner to approach the competent authority in terms of FR 54-B and as and when such an application is made before the competent authority, the same shall be disposed of in terms of FR 54-B within a period of 30 days from the date of receipt of the said application. Ordered accordingly. The writ petition accordingly stands disposed of.
