Heard Mr. S H Sikdar, learned counsel for the petitioner as well as Mr. K K Porasor, learned Additional Public Prosecutor, Assam. This is an application filed under Section 482 of the BNSS, 2023 praying for pre-arrest bail by the petitioner, namely, Sri Rupa Ram Das, in connection with Manikpur P.S. Case No. 56/2024. Page No.# 2/2 The informant has alleged in the FIR that on 14.04.2024, at about 8 PM, while her husband Fuluhar Ali along with his son were returning home in a motorcycle, they were stopped by Jabed Ali, Shahjahan Ali and Saiful Islam. Thereafter, Fuluhar Ali went to the house of the Jabed Ali and that night, Fuluhar Ali did not return home. In the next morning, dead body of Fuluhar Ali was recovered from a nearby river. Case Dairy reveals that Fuluhar Ali discovered a person called Sukhera Das was in a compromised position with a girl. Therefore, Fuluhar Ali also wanted to take part in the said act along with Sukhera Das. Knowing that fact, Sukhera Das and some other persons along with the present petitioner made a plan to murder Fuluhar Ali. Accordingly, Fuluhar Ali was killed and his deadbody was thrown into the river. There are sufficient materials against the present petitioner in the case diary. Therefore, the pre-arrest bail of the petitioner is rejected. The bail application is disposed of. Case diary shall be returned.
