Tajnur Islam v. The State of Assam

ORDER Date : 19.08.2024 Heard Mr. S. Nawaz, learned counsel for the petitioner. Also heard Mr. D. Das, learned Additional Public Prosecutor for the State of Assam.

¶2This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita

(BNSS), 2023 praying for granting anticipatory bail in respect of South Salmara P.S. Case No.152/2024. Page No.# 2/2

¶3One girl has alleged that she was in love with the present petitioner and pursuant to their affair she had eloped with him and they went to different places, spent several nights in hotels and they have physical relationship. On 06.08.2024, the present petitioner allegedly left her alone.

¶5I have considered the submissions made by learned counsel of both sides, it seems that no criminal case is made with the aforesaid allegations. Therefore the petitioner does not deserve to be detained in custody. His prayer of bail application is allowed.

¶6It is hereby directed that in the event of arrest in connection with South Salmara P.S. Case No.152/2024 the petitioner Tajnur Islam shall be released on bail of Rs.20,000/- with a surety of like amount to the satisfaction of the arresting Authority.

¶7The petitioner shall co-operate with the Investigating Officer as and when required.

¶8With the aforesaid direction the bail application stands disposed of.
