Syeda Remina Begum @ Remina Begum v. The State of Assam and 4 Ors

ORDER Date : 16-09-2024 Heard Mr. A.R. Sikdar, learned counsel for the petitioner. Also heard Mr. C. Hazarika, learned counsel appearing for the respondents No. 1 to 3 and Mr. B. Sarma, learned counsel appearing for the respondent No.4.

¶2Although notice was served upon the respondent No. 5, none has appeared on behalf of the said respondent.

¶3The petitioner has instituted the present petition claiming pension and pensionary benefits in respect of the service rendered by her late husband Late Abdul Mazid Alam being his first wife.

¶4The petitioner has filed an additional affidavit in the matter and therein has brought on record the Memorandum of Understanding entered between the petitioner and the respondent No.5 herein, in terms of which, it was agreed that the pension/gratuity/leave encashment/GPF shall be shared amongst them in equal ratio of 50:50.

¶5In view of the said Memorandum of Understanding entered between the petitioner and the respondent No.5 dated 28.03.2024, the learned counsel for the petitioner has submitted that the present writ petition be disposed of in terms thereof.

¶6I have considered the submission so advanced by the learned counsel for the petitioner. Page No.# 3/3

¶7Noticing the Memorandum of Understanding brought on record between the petitioner and the respondent No.5, the present writ petition stands disposed of in terms thereof.

¶8The interim direction passed by this Court vide order dated 16.08.2023 would stand vacated.

¶9In view of the above, the writ petition stands disposed of.
