Heard Mr. P Hazarika, learned counsel for the petitioner and Mr. M P Goswami, learned Additional Public Prosecutor, Assam. This is an application filed under Section 482 of the BNSS by the petitioner, namely, Sri Anupam Das, praying for pre-arrest bail in connection with Sivasagar P.S. Case No. 86/2024. The Secretary of Sivasagar District Legal Services Authority has lodged an FIR alleging that Page No.# 2/2 the present petitioner being the employee under her establishment had forged her signature in a document relating to the mediation system. Mr. Hazarika submits that there are other employees of the office who have access to those documents and till now, the documents have not been sent to the Handwriting Expert for examination. Mr. Goswami, on the other hand, has submitted that the Case Diary is not clear as to whether the said documents are sent to the Handwriting Expert or not. I have considered the submissions made by the learned counsel of both sides. Since the filing of the FIR in the month of July of this year and till now there is no evidence that the documents have been sent to the Handwriting Expert for examination, this court is of the opinion that no purpose shall be served by keeping the present petitioner in custody. For this reason, the pre-arrest bail of the petitioner is allowed. It is hereby directed that in the event of arrest of the petitioner, Sri Anupam Das, in connection with Sivasagar P.S. Case No. 86/2024, the arresting authority shall release him on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the arresting authority. The petitioner is directed to appear before the Investigating Officer within 7(seven) days from today and he shall make him available to the Investigating Officer as and when required. The bail application is disposed of. Case Diary shall be returned.
