¶1Heard Mr. S. Hoque, learned counsel for the petitioner.

¶2The present application is filed for impleadment of one Akash Deep, IAS, the Principal Secretary, Bodoland Territorial Council Secretariat, BTC and Jay Page No.# 3/3 Shivani, IAS, Commissioner, Panchayat & Rural Development Department, Assam in connection with Contempt Case (C) No. 46/2023. The connected Contempt Petition has been filed alleging violation of this Court order dated

17.12.2021 passed in WP(C) No. 6132/2021.

¶3By the aforesaid order a direction was given to the respondents to consider the case of the petitioner for payment of outstanding dues in terms of the determination made in Tamsher Ali & Others v. State of Assam, reported in (2008 (4) GLT 1).

¶4It is submitted by Mr. Hoque that the earlier incumbents have been transferred and these two persons are newly being appointed. It is also submitted that a certified copy of the order dated 17.12.2021 (supra) was also submitted before these two incumbents, however, even after their notice of existence of the order in question, they have not complied with this order.

¶5In view of the statement made in the Contempt Petition, this Court is of the view that the present application should be allowed by impleading the said Akash Deep, IAS, Principal Secretary, Bodoland Territorial Council Secretariat, BTC and Jay Shivani, IAS, Commissioner, Panchayat & Rural Development Department, Assam as respondent Nos. 3 & 4.

¶6Registry to do the needful for correction of the Cause Title.

¶7Petitioner shall furnish the amended Cause Title before the Registry within a period of 5 (five) days from today.
