Sultan Sekh Alias Sultan Sheikh v. The State of Assam

ORDER Date : 22.08.2024 This is a common order for these three items. Heard Mr. S. M. Abdullah P, learned counsel for the petitioners. Also heard Mr. D. Das, learned Additional Public Prosecutor for the State of Assam.

¶2The petitioners Sahajada Alom and Sultan Sekh @ Sultan Sheikh have prayed for releasing them on pre-arrest of bail in connection with Uluani P.S. Case No.88/2024.

¶3On the other hand, the petitioner Taher Ali, who is in custody in connection with the same case, since 01.08.2024 prays for releasing him on bail.

¶4The petitioners were allegedly making a plane to still Petrol products from the part Petroleum tankers. They even collected some amount of money to paying Police to protect them.

¶5Apart from that, there is no other evidence that the petitioners had ever committed theft of any articles, therefore they do not deserve to be detained in custody.

¶6The pre-arrest bail applications filed by Sahajada Alom and Sultan Sekh @ Sultan Sheikh are allowed.

¶7It is hereby directed that in the event of arrest in connection with Uluani P.S. Case No.88/2024, these two petitioners shall be released on bail of Rs.20,000/- each with a surety of like amount to the satisfaction of the arresting Authority.

¶8It is further directed that the petitioner Taher Ali shall be released on bail of Rs.20,000/- with a surety of like amount to the satisfaction of the learned SDJM, Kaliabor, Nagaon. Page No.# 4/4

¶9With the aforesaid direction, all the bail applications stands disposed of.

¶10Case Diaries shall be returned.
