ORDER Date : 12-03-2024 Pursuant to this court's order dated 04.03.2024 Mr. N Goswami learned counsel for the respondent, on instructions submits that Final Report being FR No.33/2023 dated 28.02.2023 filed in connection with Lakhipur PS Page No.# 3/3 Case No.337/2017 U/S 364(A)/34 has been placed before the jurisdictional Judicial Magistrate and the learned Magistrate has in the meantime have issued notice to the informant on 25.07.2023 for his appearance and thereafter the matter is now fixed on 25.02.2024. It is also reported that the informant has already appeared before the jurisdictional magistrate on 06.03.2024. In view of the aforesaid, this writ petition stands closed being infructous. The petitioner shall always be at liberty to raise his objection before the learned Judicial Magistrate and the Judicial Magistrate shall act as per law in the event such objection is filed. So far relating to the payment of ex-gratia, liberty is always with the petitioner to approach the appropriate authorities, if he is entitled for such ex-gratia payment in terms of the extent norms. The report dated 07.03.2024 submitted by the Superintendent of Police, Goalpara is kept on record and marked as document 'X'.
