M/S Shass Engineers v. The State of Assam and 3 Ors

ORDER 20-05-2024 Heard Mr. R. M. Deka, learned counsel for the petitioner. Also heard Mr. B. Gogoi, learned Standing Counsel, PWD and Mr. R. R. Gogoi, learned Standing Counsel for the Forest Department. It is submitted at Bar that the issue involved in this writ petition is squarely covered by the decision of this Court in the case of RCN Constructions Pvt. Ltd. (M/s) Vs State of Assam & Ors. reported in (2022) 6 GLT 362. In view of the aforesaid endorsement made by the learned counsel for the parties, this Court is of the opinion that this writ petition can be disposed of in the similar lines as in the case of RCN Constructions (supra). Ordered accordingly. Needless to clarify that the direction rendered by this Court in RCN Constructions (supra) shall apply similarly in the facts of this instant case. Let the petitioner submit the certified copy of the direction of this Court in RCN Constructions (supra) along with a copy of today's order, before the respondents. In the aforesaid terms, this writ petition stands disposed of.
