22.10.2024 Heard Mr. S Dewri, learned counsel for the petitioner and Mr. B Sharma, learned Additional Public Prosecutor, Assam for the State. 2) By this application filed under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner, namely Kuddush Ali @Abdul Kuddus, S/o Jabbar Ali, resident of No.1 Bhatia Kali, P.S. Rupohihat, District-Nagaon, has prayed for his pre arrest bail in connection with Uluani Police Station Case No. 87/2024 registered under Page No.# 2/2 Section 334(1)/305 of Bharatiya Nyaya Sanhita, 2023 corresponding to GR No. 401/2024. 3) Mr. Sharma, learned Additional Public Prosecutor, Assam has placed the relevant Case Diary of said Uluani Police Station Case No. 87/2024. 4) It is seen that the Court by order dated 28.08.2024, granted interim bail to the petitioner, named above, in said Uluani Police Station Case No. 87/2024, pursuant to which he appeared before the concerned Investigation Officer on 01.09.2024 and his statement was recorded by the Investigating Officer of said Uluani Police Station Case No. 87/2024. 5) Considering the materials in the Case Diary and on hearing the parties, the interim bail granted to the petitioner on 28.08.2024 in the said Uluani Police Station Case No. 87/2024 is hereby made absolute, subject to the compliance of the conditions as specified in said order dated 28.08.2024, passed earlier in the present proceeding. 6) With the above observations and directions, the prayer for pre arrest bail of the petitioner, named above, stands allowed to the extent above. 7) Return the Case Diary.
