ORDER

22.08.2024

¶1Heard Mr. A.A.R. Karim, learned counsel for the petitioner, who submits that the respondent No.2 has issued a Notice Inviting Quotation (hereinafter referred to as the 'NIQ') dated 16.08.2024 for operating the staff canteen at Nalbari Medical College & Hospital, Nalbari on temporary basis, until completion of the formal tender process for canteen services, considering the urgent necessity of a staff canteen.

¶2The petitioner's counsel submits that he came to know of the NIQ only on

20.08.2024. He submits that the time given in the NIQ for submission of a bid is only one week and as the time period is very limited, the petitioner would not be able to submit his tender documents within such a limited time period. He submits that the petitioner should be given some extra time, i.e., till 27.08.2024 for submission of his tender documents.

¶3Mr. A. Chaliha, learned counsel for the Health Department submits upon instructions, that the operation of the staff canteen would only be on a temporary basis consisting of 3 to 4 months. He submits that during that time a regular tender notice would be issued for operating the staff canteen on a regular basis. He also submits that as per instructions received by him, the petitioner may submit his tender documents by 26.08.2024.

¶4On hearing the counsels for the parties, this Court is also of the view that some more time should have been given to the intending bidders for submission of the Page No.# 3/3 tender documents. As 26.08.2024 is a State Government holiday due to Janmashtami, the petitioner is granted time till 11:00 a.m. on 27.08.2024 for submission of his tender documents. Thereafter, the bids of the tenderers may be opened by the respondents.

¶5The writ petition is accordingly disposed of.
