Heard Mr. R. Sarmah, the learned counsel appearing on behalf of the petitioner as well as Mr. J. Chutia, the learned standing counsel of the KAAC.

¶2The petitioner herein have approached this Court on an apprehension that inspite of the fact that the petitioner is the highest bidder in respect to Jamuna River Sand Mahal at Kadam bagan under Karbi Anglong Forest East Division, Diphu and there was a move to grant the contract to some other person.

¶3MR. J. Chutia, the learned standing counsel appearing on behalf of the KAAC submitted that the Department is not inclined to grant the allotment to any of the bidders taking into account that the local peoples have not permitted the KAAC to extract sand from that particular Sand Mahal.

¶4Under such circumstances, the KAAC have taken a decision to shift the Sand Mahal to some other locality. Page No.# 3/3

¶5Taking into account the above, the apprehension of the petitioner no longer survives and accordingly the instant writ petition is closed being devoid of the cause of action. JUDGE Comparing Assistant
