ORDER
26.09.2024
Heard Mr. B Haldar, learned counsel for the petitioner as well as Mr. R J Baruah, learned Additional Public Prosecutor, Assam. This is an application filed under Section 483 of the BNSS, 2023 by the petitioner, namely, Sri Sukhinath Bhumik @ Bhowmick, praying for release on bail, who was arrested in connection with Bongaigaon P.S. Case No. 275/2024. Page No.# 2/2 The son-in-law has lodged an FIR before Police alleging that because of political rivalry, his father-in-law was attacked by the present petitioner along with three others on 09.08.2024, at about 10.30 AM. It is also alleged that the attackers had used sharp weapon and stick to assault his father-in-law. I have considered the submission of the learned counsels for both the parties. Till now, there are no materials in the Case Diary to justify further detention of the petitioner. Moreover, he has already completed 47 [forty seven] days in judicial custody. For these two reasons, the bail prayer of the petitioner is allowed. Accordingly, it is hereby directed that the petitioner Sri Sukhinath Bhumik @ Bhowmick, who was arrested in connection with Bongaigaon P.S. Case No. 275/2024 shall be released on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Bongaigaon. The bail application is disposed of. Return the Case Dairy.
