Heard Mr. S M Abdullah P, learned counsel for the petitioner as well as Ms. S H Bora, learned Additional Public Prosecutor, Assam. This is an application filed under Section 482 of the BNSS, 2023 by the petitioner, namely, Rinku Muktiar, praying for pre-arrest bail in respect of Uluani P.S. Case No. 88/2024. Page No.# 2/2 The petitioner along with some other persons was making a plan to commit theft of petroleum products from a waiting petroleum tanker. On 22.08.2024, this Court in AB No. 2206/2024 granted pre-arrest bail to another person for the same offence. This Court is of the opinion that same view should be taken in this case also. Therefore, the prayer for pre-arrest bail of the petitioner is allowed. Accordingly, it is hereby directed that in the event of arrest of the petitioner, namely, Rinku Muktiar, in connection of Uluani P.S. Case No. 88/2024, the arresting authority shall release him on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the arresting authority. Petitioner is directed to cooperate with the investigation as and when required. The bail application is disposed of.
