Heard Mr.G. Chamuah, learned counsel appearing for the petitioner as well as Mr. B. Sarma, learned Additional Public Prosecutor appearing for the state of Assam.

¶2This is an application under Section 482 of the BNSS, 2023 praying for grant of pre-arrest bail in respect of Abhayapuri P.S. Case No. 193/2024. Page No.# 2/2

¶3Pursuant to the interim bail granted by this Court on 02.09.2024, the petitioner has appeared before the Investigating Officer and got his statement recorded.

¶4Mr. Sarma has submitted that the co-accused has implicated the petitioner and the investigating officer has collected incriminating materials against the present petitioner.

¶5I have considered the submissions made by the learned counsels of both sides.

¶6The petitioner has already appeared before the Investigating Officer and got his statement recorded and he has been co-operating with the Investigating Officer.

¶7Considering the aforesaid facts, this Court is of the opinion that the petitioner does not deserve to be detained in custody, The pre-arrest bail application filed by the petitioner is allowed.

¶8The interim order dated 02.09.2024 is hereby made absolute.

¶9With the aforesaid direction, the bail application stands disposed of. The CD shall be returned.
